Mr. Falleri refuses to provide our attorney with a copy of the complaint

(Response dated 9/27/99 from Alan Falleri: excerpts therefrom:)

The zoning code organizes various land uses into 'use types'. In the Gould case, our office has determined that the raising of parrots and similar birds best fits in the Animal Sales and Services Household Pets commercial use type. The Gould property is within the Agricultural zoning district which does not provide for the above use type in either the 'principal permitted uses' or the conditional uses in the AG zone. Therefore, there is no way (other than to amend the Coastal Land Use Plan and zoning ; a very long and complex process) for our department to grant a zoning clearance for the Goulds operation at their present location.

As provided, this can be appealed by writing a letter to this office and paying $1120.00......

I am sorry that I can not comply with your request to provide a copy of the complaint form. Our County Counsel has advised us not to provide information from complaint files where the name or other information which could identify the complainant can be discerned (see enclosed copy of Dale Hawley's letter dated 9/27/99) Normally, we can just block the name of the complainant out of the copy we would send to you, however, in this case, the written description of the complaint itself contains information which might identify the complainant.


This indicates that early on, the county counsel was in on this decision, and several attempts to obtain a copy of the complaint have been denied.

We still, at this writing, do not have a copy.
